Terms of Service

To use certain features of our Services, you must register for an account. When registering, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old to create an account and use our Services. By creating an account, you represent and warrant that you are at least 18 years old.

You agree not to create more than one account per person, and not to transfer your account to any other person. Kurimacye reserves the right to suspend or terminate your account if any information provided is found to be inaccurate, not current, or incomplete.

You agree not to use our Services for any purpose that is unlawful or prohibited by these Terms. By using our Services, you agree not to:

• Post or list illegal, counterfeit, or stolen items
• Infringe upon any third-party intellectual property rights
• Manipulate the price of any item or interfere with listings
• Post false, inaccurate, misleading, deceptive, defamatory, or libelous content
• Take any action that imposes an unreasonable load on our infrastructure
• Use our Services for any commercial purpose not expressly authorized by Kurimacye
• Collect or harvest any personally identifiable information from the Services
• Circumvent, disable, or otherwise interfere with security-related features
• Impersonate another person or misrepresent your affiliation with any person or entity
• Engage in any form of harassment, hate speech, or harmful behavior toward other users

Kurimacye reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision, including removing prohibited content, suspending or terminating accounts, and reporting violators to law enforcement authorities.

As a seller, you are responsible for ensuring that your listings comply with all applicable laws and regulations. All items must be accurately and completely described, including any defects, damages, or wear. The price stated in your listing must include all fees and charges that a buyer must pay to purchase the item, excluding shipping costs which may be listed separately.

Sellers must fulfill all orders promptly and as described in their listings. Cancellations, returns, and refunds are subject to Kurimacye's policies and procedures.

As a buyer, you agree to pay the full price for items you purchase.

Kurimacye reserves the right to remove any listing from our Services at any time and for any reason, in our sole discretion, including but not limited to listings that violate these Terms or our policies.

Kurimacye charges fees for certain aspects of our Services. Fees may include, but are not limited to, transaction fees, payment processing fees, and subscription fees. All applicable fees are disclosed to sellers before they complete a transaction.

You authorize Kurimacye to charge the payment method you provide for any fees incurred. All fees are non-refundable unless otherwise specified by Kurimacye or required by applicable law.

Payments for purchases made through our Services are processed by third-party payment processors. By using our Services, you agree to comply with the terms and policies of these payment processors in addition to these Terms.

The Services and all content, features, and functionality thereof, including but not limited to text, graphics, logos, icons, images, audio clips, software, and the design, selection, and arrangement thereof, are owned by Kurimacye, its licensors, or other providers and are protected by copyright, trademark, and other intellectual property laws.

By submitting, posting, or displaying content on or through our Services, you grant Kurimacye a non-exclusive, royalty-free, worldwide, fully paid, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media formats and through any media channels for the purpose of providing and promoting our Services.

You represent and warrant that you own or have the necessary rights to grant the license set forth in this section, and that your content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity.

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

Kurimacye does not warrant that: (a) the Services will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the Services are free of viruses or other harmful components; or (d) the results of using the Services will meet your requirements.

Kurimacye does not endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through our Services or any hyperlinked website or service.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL KURIMACYE, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

In no event shall Kurimacye's total liability to you for all claims related to the Services exceed the amount paid by you to Kurimacye during the twelve (12) months preceding the event giving rise to the liability, or one hundred dollars ($100), whichever is greater.

You agree to defend, indemnify, and hold harmless Kurimacye, its directors, employees, partners, agents, suppliers, and affiliates, from and against any claims, liabilities, damages, losses, and expenses, including without limitation reasonable attorneys' fees and costs, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any intellectual property right, publicity, confidentiality, property, or privacy right
• Any claim that your content caused damage to a third party
• Any transaction or relationship between you and any other user of the Services

Kurimacye may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with the laws of the Republic of Rwanda, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the Kigali International Arbitration Centre (KIAC), which rules are deemed to be incorporated by reference into this clause. The number of arbitrators shall be one. The seat of arbitration shall be Kigali, Rwanda. The language to be used in the arbitral proceedings shall be English.

Not with standing the foregoing, Kurimacye retains the right to bring any suit, action, or proceeding against you for breach of these Terms in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
